    1. Notification Requirement: The claimant must promptly notify Vemar in writing within the Warranty Period upon discovering a “failure.” The notification should include a detailed description of the issue and at least four horizontal photos of the boat: two of the bow and two of the stern. The photos should be clear and of high quality.
    2. Inspection Process: An inspection may be conducted by a Vemar authorized representative to assess whether the failure is covered by the Product Warranty.
    3. Sample Collection: If further investigation is needed, Vemar may request a surface sample from the affected area for laboratory analysis. In such a case specific and clear instructions will be provided to the claimant in order to collect and send the sample for further lab tests.
    4. Response Time: Vemar will respond to the claim within 7-10 working days.
    5. Results Notification: The claimant will be noticed of the results and proposed actions via electronic mail.
    6. Coverage Determination: If Vemar determines, at its sole discretion, that the claim is covered under the Product Warranty, reimbursement for necessary repairs will be based on the terms of the existing commercial agreement between Vemar and the claimant.
    7. Non-Coverage Consequences: If Vemar concludes, at the time of inspection, that the claim is not covered by the Product Warranty, or if the claimant fails to provide notice within the Warranty Period, Vemar will not be liable for the repair costs. The responsibility for any paint failure will rest solely with the claimant.
    8. Product Performance: Vemar warrants the quality and performance of its products based on laboratory testing and documented experience, adhering strictly to the Application Process outlined in the product’s Product Data Sheet (PDS). However, performance under actual usage conditions is not guaranteed, as these conditions may vary beyond Vemar’s control and must be evaluated by the user.
